Saiful Apek to prepare defence


Malaysian actor Saiful Apek and his three employees are charged with taking marijuana three years ago.

24 May – Actor and comedian Saiful Apek, who was previously freed of the charges against him and his three employees for taking marijuana last year, is now ordered by the High Court to prepare his defence yesterday, upon review of the prosecution's appeal against the magistrate's decision.

According to The Star, High Court judge Datuk Abdul Alim Abdullah made the decision after reviewing the prosecution's appeal against the decision of the Petaling Jaya's Magistrate Court that resulted in all charges against the four being dropped on 25 June last year.

Alim Abdullah's reason for his ruling is that he tried to detect the loopholes in the prosecution's charges but failed to find any.

"The urine tests of the four defendants turned out to be positive for marijuana, so how can the court rule that the officer in charge of the tests is lying? Humans make mistakes, and doing drugs is also a mistake. The court places emphasis on justice, so I'm dismissing all rulings made by the Magistrate and the defendants are ordered to prepare their defence for this case in the same Magistrate Court," said Alim Abdullah.

The hearing will take place on 27 May 2013 at Petaling Jaya's Magistrate Court and bail is set at RM 2,000 each. If they are found guilty, they are liable to do up to two years in prison or pay a fine of RM 5,000.

Aside from Saiful Apek, whose real name is Mohd. Saifulazam Mohamed Yusoff, 43, the defendants are Shah Zainatul Ehsan Al-Muazam Shah Yahya, 29, Shaiful Baharom, 25, and Noremy Mohamad, 29.
